A FUNÇÃO SOCIAL DA NEGOCIAÇÃO COLETIVA COMO INSTRUMENTO DEMOCRÁTICO DE CRIAÇÃO DE DIREITOS TRABALHISTAS: história, contextualização, comum acordo e desafios
Resumo
A história dos sindicatos e do sindicalismo teve uma trajetória peculiar no Brasil, pois, por muito tempo, eles foram controlados pelo Estado em nome do bem da nação, assumindo, o ente coletivo, não raro, mais uma postura assistencialista do que de luta em prol dos trabalhadores. Uma das formas de intervenção estatal ocorria através do Poder Normativo da Justiça do Trabalho o que acabava por comprometer a negociação coletiva – e seu potencial democrático e social transformador – na medida em que as partes se submetiam à tutela judicial ao invés de investir esforços nas tratativas autônomas. A CR/88 representou um marco para o movimento de classe pelos avanços trazidos, entretanto, como alguns resquícios corporativistas foram mantidos, a luta continuou e por meio da EC 45/04 foi mitigado o poder normativo através da exigência do comum acordo para instauração do dissídio coletivo. O requisito foi objeto de muitas críticas em especial sob os aspectos constitucional, processual e da realidade sindical atual, demonstrando a importância da análise do tema. O objetivo do presente trabalho é fazer um breve estudo histórico do sindicalismo pátrio, da função democrática da negociação coletiva e das repercussões da nova exigência constitucional fomentando o debate a seu respeito. A pesquisa será desenvolvida no âmbito do Direito Coletivo do Trabalho e Constitucional, sendo utilizado o método de procedimento observacional, através de pesquisas teóricas, por meio da análise de conteúdo. Ainda serão utilizados dados primários – jurisprudência e legislação – e secundários – livros didáticos e artigos de revistas de autores clássicos e contemporâneos.

The history of unions and unionism was a peculiar trajectory in Brazil, because for too long they have been controlled by the state on behalf of the good of the nation, assuming the collective being, often, more paternalistic stance than struggle on behalf of workers. One of the forms of state intervention occurred through the Legislative Branch of the Labour Court which would eventually undermine collective bargaining - and its democratic and social potential transformers - the extent to which the parties subjected to judicial custody instead of investing efforts in the talks autonomous. The CR / 88 represented a milestone for the movement of the class brought advances, however, as some corporatist remains were kept, and the fight continued through 45/04 EC legislative power was mitigated by requiring the agreement for the establishment collective bargaining. The requirement has been the subject of much criticism especially under the constitutional, procedural and present union reality aspects, demonstrating the importance of analysis of the topic. The aim of this work is to make a brief historical analysis of paternal unionism, democratic function of collective bargaining and the impact of the new constitutional requirement fueling the debate about her. The research will be conducted under the Collective Labour Law and Constitutional, the method being used observational procedure, through theoretical research, by means of content analysis. Still be used, primary data - case law and legislation - and secondary - textbooks and magazine articles from classic and contemporary authors.
