Abstract

Migrant subjects, despite having their rights recognized by a set of national and international instruments, remain subject to the logic of sovereignty of national States in exercising legislative, administrative and jurisdictional prerogatives in the design of legal frameworks and public policies. In this article, a historical journey of national legislation on migration and the international migrant in Brazil in the period between 1880-2017 is outlined, with the aim of reflecting on the effectiveness of the guarantees provided for constitutionally and in the Migration Law/2017. Guided by the dialectical-critical reading of reality based on the literature review and documentary research, the qualitative theoretical-methodological perspective facilitated the overcoming of dichotomies and dualisms between forced and voluntary migration.
