RÁDIO EDUCATIVA E RÁDIO PÚBLICA: semelhanças e diferenças à luz da legislação

RESUMO: O rádio brasileiro percorre um caminho que se inicia educativo, abre-se para o comercial e tardiamente estabelece em lei as prerrogativas do caráter público. Apesar disso, tem sido comum associar rádio educativa e rádio pública como sinônimos. Este artigo defende a hipótese de que, a despeito de possuírem pontos comuns no que tangem às características da programação e às restrições quanto à veiculação de publicidade comercial, rádios educativas e rádios públicas pertencem a conjuntos diferentes, por serem legisladas a partir de leis diferentes. Para chegar a este objetivo, o trabalho apresenta um breve histórico do rádio no Brasil e do desenvolvimento das legislações em torno do tema. ABSTRACT: Brazilian radio runs a educative starting way, turns it up to the commercial way and lately establishes in law the prerogatives of the public character. In despite of it, it’s been usual to associate educative radio and public radio as synonymous. This article supports the hypothesis that educative and public radios belong to different parts, because they are legislated from different laws, although they have common appointments in relation to the characteristics of the programming and to the commercial placement restrictions. In order to achieve this goal, the actual work presents a soon historical of Brazilian radio and the development of the laws around this subject.
