DIRITTI FONDAMENTALI E LOTTA AL TERRORISMO INTERNAZIONALE NELLA GIURISPRUDENZA DELLA CORTE DI GIUSTIZIA: l’eredità del caso Kadi

Resumo

A análise da jurisprudência do Tribunal de Justiça que, em vários maneira e com intensidade diferente, seguiu a decisão de Kadi do 20082, oferece uma oportunidade para refletir sobre alguns dos principais problemas representado pelo impacto das ferramentas antiterroristas sobre os ativos de cooperação internacional e europeia, mas também sobre o questão geral de ponderação entre liberdade e segurança.

Abstract

The analysis of the jurisprudence of the Court of Justice which, in various way and with different intensity, has followed the Kadi ruling of the 20082, offers an opportunity to reflect on some of the main problems posed by the impact of counter-terrorism tools on assets of international and European cooperation, but also on the most general question of weighting between freedom and security.
